{"id":1251,"date":"2013-09-26T19:12:04","date_gmt":"2013-09-26T17:12:04","guid":{"rendered":"https:\/\/www.ccooservicios.es\/madrid\/2013\/09\/26\/acuerdo-sobre-ultraactividad-en-gabinete-tecnico-de-prevencion\/"},"modified":"2013-09-26T19:12:04","modified_gmt":"2013-09-26T17:12:04","slug":"acuerdo-sobre-ultraactividad-en-gabinete-tecnico-de-prevencion","status":"publish","type":"post","link":"https:\/\/www.ccooservicios.es\/madrid\/2013\/09\/26\/acuerdo-sobre-ultraactividad-en-gabinete-tecnico-de-prevencion\/","title":{"rendered":"ACUERDO SOBRE ULTRAACTIVIDAD EN \u00abGABINETE T\u00c9CNICO DE PREVENCI\u00d3N\u00bb"},"content":{"rendered":"<p>Comfia-CCOO y FeS-UGT ALCANZAN UN ACUERDO EN LA&nbsp;EMPRESA \u201cGABINETE T\u00c9CNICO DE PREVENCI\u00d3N\u201d (Grupo&nbsp;PREVING), EN RELACI\u00d3N CON LA ULTRAACTIVIDAD DEL&nbsp;CONVENIO SECTORIAL.<\/p>\n<p>El d\u00eda 24 de septiembre se ha celebrado el acto de mediaci\u00f3n en el SIMA (Servicio&nbsp;Interconfederal de Mediaci\u00f3n y Arbitraje) promovido por ambos sindicatos contra la&nbsp;empresa \u201cGabinete T\u00e9cnico de Prevenci\u00f3n, S.L.\u201d como consecuencia de la decisi\u00f3n&nbsp;empresarial de poner fecha de finalizaci\u00f3n a la aplicaci\u00f3n del Convenio, alegando haber&nbsp;deca\u00eddo por aplicaci\u00f3n de la Reforma Laboral.&nbsp;<\/p>\n<div>\n<\/div>\n<div>En dicho acto de mediaci\u00f3n, FeS-UGT y Comfia-CCOO expresaron una vez m\u00e1s su criterio de que el&nbsp;Convenio Sectorial incluye una cl\u00e1usula en el art\u00edculo 4, donde se establece claramente que el&nbsp;convenio mantendr\u00e1 su vigencia en tanto no se logre un acuerdo expreso que lo sustituya.&nbsp;<span style=\"font-size: 9pt;\">En este&nbsp;sentido y argumentando la reciente sentencia dictada por la Audiencia Nacional sobre el convenio&nbsp;colectivo de la empresa Air Nostrum que contiene una cl\u00e1usula similar, se logr\u00f3 que los representantesde Gabinete T\u00e9cnico de Prevenci\u00f3n entraran en razones y aceptasen un acuerdo comprometi\u00e9ndose a&nbsp;mantener la aplicaci\u00f3n del Convenio.&nbsp;<\/span>\n<\/div>\n<div><span style=\"font-size: 9pt;\"><br \/><\/span>\n<\/div>\n<div><span style=\"font-size: 9pt;\">El acuerdo establece literalmente lo siguiente:&nbsp;<\/span>\n<\/div>\n<div><span style=\"font-size: 9pt;\"><br \/><\/span>\n<\/div>\n<div><span style=\"font-size: 9pt;\"><i>\u201cLa empresa se compromete a mantener las condiciones fijadas en el I Convenio Colectivo&nbsp;Nacional de Servicios de Prevenci\u00f3n Ajenos hasta tanto en cuanto se dicte sentencia firme&nbsp;referente a la ultraactividad del citado convenio, acatando ambas partes el sentido de dicha&nbsp;sentencia o se llegue a un acuerdo en la negociaci\u00f3n colectiva de un nuevo convenio.&nbsp;<\/i><\/span>\n<\/div>\n<div><span style=\"font-size: 9pt;\"><i>La empresa comunicar\u00e1 el presente acuerdo individualmente a todos los trabajadores. Como&nbsp;consecuencia del presente acuerdo, las organizaciones sindicales proceder\u00e1n a desistir del&nbsp;conflicto planteado\u201d.&nbsp;<\/i><\/span>\n<\/div>\n<div><span style=\"font-size: 9pt;\"><br \/><\/span>\n<\/div>\n<div><span style=\"font-size: 9pt;\">Nos congratulamos de que por parte de la empresa se haya puesto una dosis de cordura en este&nbsp;conflicto, evitando as\u00ed el que hubiese sido el primer juicio en la Audiencia Nacional sobre la&nbsp;ultraactividad del mencionado convenio.
