El documento pretende ser una referencia para las negociaciones que deben abordar los distintos comités de esta empresa, en la vuelta a la actividad comercial <\/p>\n
Era<\/strong> <\/strong>una<\/strong> <\/strong>necesidad.<\/strong> La desescalada en el estado de alarma, con reactivación de los establecimientos comerciales en un nuevo entorno de medidas preventivas, conlleva una adaptación de medidas organizativas, complejas, y donde no pocos derechos corren el riesgo de ser obviados.<\/p>\n Es en ese marco, en el que las negociaciones de las medidas de adaptación a la nueva realidad deben de acompañar a la reincorporación de la plantilla, donde la necesaria celeridad en la toma de decisiones, la vigilancia del derecho a la salud y las complejidades de todo ello, unido a una nueva necesidad de conciliación de carácter colectivo, han hecho del todo necesaria esta negociación. <\/p>\n La pretensión de poder fijar una hoja de ruta previa para el mejor desarrollo de todas esas negociaciones que los comités deben afrontar, ha servido ya, en primer lugar, para corregir planteamientos empresariales ante los que las organizaciones sindicales veíamos serios peligros. <\/p>\n Así pues, se han concretado los siguientes extremos: <\/p>\n – Las<\/strong> <\/strong>medidas<\/strong> <\/strong>excepcionales<\/strong> <\/strong>que<\/strong> <\/strong>se<\/strong> <\/strong>acuerden<\/strong> <\/strong>tendrán<\/strong> <\/strong>carácter<\/strong> <\/strong>temporal<\/strong>,<\/strong> quedando todas ellas supeditadas a la finalización de la desescalada o autorización de la normativa sanitaria para la vuelta a la normalidad. <\/strong><\/p>\n – Nueva<\/strong> <\/strong>organización<\/strong> <\/strong>de<\/strong> <\/strong>turnos,<\/strong> <\/strong>de acuerdo con las directrices de sanidad, con la propuesta de 3 opciones a acordar en cada centro de trabajo con la representación legal de los trabajadores: <\/p>\n a) Tres mañanas, tres tardes. <\/p>\n b) Una semana de mañana, una semana de tarde. <\/p>\n c) Turnos fijos de mañana y de tarde <\/p>\n Si ello implicara una menor jornada laboral semanal respecto a la habitual, estas horas serán consideradas como “retribuidas y recuperables” hasta el 31 de Enero 2021 <\/p>\n – Respeto<\/strong> <\/strong>de<\/strong> <\/strong>las<\/strong> <\/strong>reducciones<\/strong> <\/strong>de<\/strong> <\/strong>jornada<\/strong> <\/strong>en<\/strong> <\/strong>todo<\/strong> <\/strong>caso.<\/strong> <\/strong>Como derecho fundamental de conciliación, que deberá de ser contemplado también bajo los parámetros de seguridad y derecho a la salud. <\/strong><\/p>\n – Vacaciones.<\/strong> <\/strong>Con el respeto de las reglas convencionales de disfrute (convenios colectivos). <\/strong><\/p>\n a) INVIERNO. Los periodos que haya pendientes de disfrute, deberán de liquidarse antes del 15 de junio de 2020. <\/p>\n b) VERANO. Planificación excepcional de acuerdo con la RLT, estableciéndose, en caso de necesidad, que limitación del número de personas por turno. <\/p>\n – Reasignación<\/strong> <\/strong>de<\/strong> <\/strong>centro<\/strong> <\/strong>de<\/strong> <\/strong>trabajo<\/strong> <\/strong>y\/o<\/strong> <\/strong>funciones.<\/strong> <\/strong>Bajo la premisa fundamental de garantizar los puestos de trabajo y la salud, con carácter temporal. <\/strong><\/p>\n – Medidas<\/strong> <\/strong>de<\/strong> <\/strong>conciliación<\/strong> <\/strong>laboral<\/strong> <\/strong>y<\/strong> <\/strong>flexibilización<\/strong> <\/strong>de<\/strong> <\/strong>los<\/strong> <\/strong>Planes<\/strong> <\/strong>de<\/strong> <\/strong>Igualdad.<\/strong> <\/strong>Ahora más que nunca, las necesidades de conciliación son acuciantes para la práctica totalidad de la plantilla. <\/strong><\/p>\n a) Permiso retribuido recuperable por circunstancias de conciliación familiar, aplazando parte de la jornada a realizar en otro momento del año y reajuste de pagas extras en caso de imposibilidad de la devolución de esa jornada. <\/p>\n b) Flexibilización de los permisos no retribuidos y\/o recuperables por necesidades de conciliación facial ir hasta los 14 años. <\/p>\n c) Adaptar y concretar la jornada sin reducirla, para aquellos que tengan familiares con una discapacidad igual o superior al 33%. <\/p>\n d) Personas con derecho a la reducción de jornada establecida en el art. 37.6 de E.T, posibilidad de acumulación de los periodos de reducción por días completos, si el causante reside en el extranjero o bien tenga una discapacidad superior al 33% o reconocido carácter dependiente. Permiso acumulable a las vacaciones con independencia al lugar de residencia del menor. <\/p>\n e) Prioridad de elección del periodo vacacional a personas trabajadoras con hijos menores de 14 años en situación monoparental. <\/p>\n f) Excedencia con reserva de puesto de trabajo de hasta dos meses para cubrir necesidades personales que podrá unirse a licencias retribuidas con la debida justificación. <\/p>\n g) Ofrecimiento de mayor flexibilidad para adaptar las concreciones horarias a las nuevas necesidades de la persona trabajadora, siempre con carácter voluntario. <\/p>\n – Comisión<\/strong> <\/strong>de<\/strong> <\/strong>Seguimiento.<\/strong> <\/strong>Creación de este órgano que tendrá como función la de velar por la correcta implantación de cuantas medidas se acuerden, y determinar las adaptaciones de las medidas recogidas en este acuerdo ante las situaciones que, en estos momentos tan inciertos, pudieran surgir. <\/p>\n Ambas organizaciones sindicales valoramos positivamente este acuerdo que pone de manifiesto la voluntad de las partes sociales de llegar a la “nueva normalidad” de una manera conjunta preservando<\/strong> <\/strong>el empleo.<\/strong> <\/strong><\/p>\n <\/p>\n It was a necessity. The de-escalation in the state of alarm, with the reactivation of commercial establishments in an environment of preventive measures, entails the implementation of complex organisational measures, where a significant number of rights are at risk of being overlooked.<\/p>\n Within this framework, in which the negotiations of adaptation measures to the new reality must support the reintegration of the workforce, and where the needed speed in decision-making, the monitoring of the right to health and the complexities of all of this, together with the new need for collective conciliation, have made this negotiation absolutely necessary.<\/p>\n The pretence of being able to set a roadmap for the better development of these negotiations that the committees will face, has served to, firstly, correct business approaches in which as trade unions we had seen serious threads.<\/p>\n Thus, the following points have been defined:<\/p>\n The exceptional measures agreed shall be temporary, all of which are subject to the completion of the de-escalation or the authorisation to return to normal activity from the health legislation.<\/p>\n<\/li>\n New organisation of shifts, in accordance with the healthcare guidelines, with 3 proposed options to be agreed in each workplace with the legal representation of the workers:<\/p>\n<\/li>\n<\/ul>\n Three mornings, three afternoons.<\/p>\n A week in the morning, a week in the afternoon.<\/p>\n Fixed morning and afternoon shifts.<\/p>\n If this implied a reduction in weekly working hours from the usual, the difference in hours will be considered as “paid and recoverable” until 31 January 2021.<\/p>\n Regards, in any case, to reductions in working hours<\/strong>. This leave is cumulative to the period of holiday regardless of the place of residence of the minor.<\/p>\n<\/li>\n Priority in the choice of holiday period for single working parents with children under 14 years.<\/p>\n<\/li>\n Leave of absence for up to two months with job security to cover personal needs, which may be joined to paid leave with adequate justification.<\/p>\n<\/li>\n Provision of greater flexibility to adapt time concretions to the new needs of working people, always on a voluntary basis.<\/p>\n<\/li>\n<\/ol>\n Monitoring committee.
